GENERAL LECTURE WEEK – “The Capital of the State and the Legal Aspects of the Development of the Capital of the Archipelago”

Jakarta, 18/10/2022. With the name Nusantara, the capital city of the Republic of Indonesia represents the concept of unity that accommodates Indonesia’s rich plurality. The reality of Indonesia’s pluralistic wealth becomes social capital to advance people’s welfare, for Indonesia to be advanced, resilient, and sustainable.

The Capital of the Archipelago (IKN) has been agreed in the form of a special regional government unit at the provincial level whose territory is the seat of the State Capital and the designation of the IKN Authority as a government in the special area of the Capital of the Archipelago is given to respond to the development of the current digital era in facilitating the implementation of all activities. The Faculty of Law, Pancasila University (FHUP) has held a Public Lecture with the theme “The Capital of the State and the Legal Aspects of the Development of the Capital of the Archipelago”. The General Lecture which was attended by approximately 400 participants from students, lecturers, legal practitioners and the general public, presented the Secretary of the Archipelago Capital Authority Agency, Dr. Achmad Jaka Santos Adiwijaya and Dr. Mahendra Putra Kurniawan, S.H., M.H, Lecturer and Dean of the Faculty of Law, Mulawarman University, Samarinda, East Kalimantan, as speaker.

Dr. Achmad Jaka Santos Adiwijaya, as the first resource person, said that in managing the State Capital, apart from being a means to meet the needs of the Indonesian people, it is also to create a safe, modern, sustainable, and resilient State Capital and become a reference for development and other regional arrangements in Indonesia. The Law on the State Capital (Law Number 3 of 2022) has accommodated plans to realize the concept of IKN development which has the characteristics of Green, Inclusive, Smart, Resilient and Sustainable City, by prioritizing the concepts of Forest City, Sponge City, and Smart City. Forest City is an area dominated by a forest structured landscape that has the function of ecosystem services to create coexistence with nature. At least, there is 65% protected area, 25% built area, and 10% is used for food land. Sponge City is a city with very good infiltration so as to reduce the danger of flooding and improve the quality and quantity of water; Smart Cities that are dynamic, inclusive, supported by the community and ready to face the future through the use of technology as an accelerator to improve city performance and quality, such as concept development smart city and smart mobility.

He continued, Jaka Santos said that city development in the context of building civilization needs to be balanced and guarded by comprehensive laws and regulations. In addition, he also encouraged universities, especially the Pancasila University which bears the name Pancasila, to be the driving force for the birth of legislative institutions that can provide various academic texts regarding arrangements for realizing a smart city based on Pancasila.

In the second session, Dr. Mahendra Putra Kurniawan, S.H., M.H, as a resource person discussed “Relocation of the State Capital and Protection of the Rights of Affected Communities”. In his presentation, Mahendra focused on the provisions of Article 21 and Article 37 of Law no. 3 of 2022, which is related to the protection of individual and communal rights of indigenous peoples and cultural values that reflect local wisdom. In particular, the subjects affected by the IKN development are people/community and indigenous people/communities in North Penajam Paser Regency and Kutasi Kartanegara Regency.

He said that the Faculty of Law, Mulawarman University is currently carrying out 25 (twenty five) studies with a major theme on the implications for the development of the Capital of the Archipelago. Temporary findings from some of these studies show that there are legal problems with local people’s land tenure, traditional knowledge and customs are still alive even though they have begun to shift to a “pragmatic” direction, and local community involvement in IKN development is still very weak which should not be replaced with participation. other.

At the end of his presentation, it was stated that legal protection for communities affected by IKN development must have the aim of not ignoring the rights of the community, the target is to increase stakeholder understanding on the rights of affected communities and increasing public understanding of personal or communal rights as affected subjects, policy directions to provide protection of community rights as affected subjects by relocating the state capital, and strategies carried out by looking back at the relocation of the state capital and communication, informative, transparent, participatory with the community as subjects affected by IKN development.

This activity was opened by the Dean of the Faculty of Law, University of Pancasila, Prof. Dr. Eddy Pratomo, S.H., M.A. It was stated in his speech that this public lecture was a series of Public Lecture Week activities which were held on October 17-21, 2022. This activity is a routine program of FHUP in every semester which is attended by various sources, both from academics and practitioners in the field of law as well as from government agencies.

In addition, this activity is also an implementation of the Merdeka Campus Competition Program in 2022 which has been won by FHUP for the second time, as well as a realization of cooperation between FHUP and cooperation partners.
